1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the SnapFood mobile application and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

The Service is owned and operated by BaytByte ("SnapFood," "we," "our," or "us"). We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Service Description

SnapFood is a mobile application that uses artificial intelligence to analyze food photos and provide nutritional information. The Service allows users to:

• Take photos of food and receive nutritional analysis
• Track meals and nutritional intake
• Set and monitor dietary goals
• Access personalized nutrition insights

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

3. Account Registration

To use certain features of the Service, you may need to create an account. When you create an account, you agree to:

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or dietary needs.

SnapFood uses AI technology to analyze food images and estimate nutritional content. While we strive for accuracy, we cannot guarantee that all nutritional information is 100% accurate. Factors such as image quality, lighting conditions, and food preparation methods may affect the accuracy of our analysis.

You should not rely solely on the information provided by SnapFood to make health decisions. SnapFood is not responsible for any health problems that may result from diet plans, recipes, or other information provided through the Service.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by BaytByte and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial use.

You retain ownership of any content you submit to the Service, including food images. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of providing and improving the Service.

7. Subscription and Payments

SnapFood offers both free and premium subscription options. By subscribing to a premium plan, you agree to the following:

• You authorize us to charge the applicable fees to your designated payment method
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel your subscription through your account settings or the app store
• No refunds will be issued for partial subscription periods

We reserve the right to change our subscription fees at any time. Any changes will be communicated to you in advance and will apply to the next billing cycle.

8. Limitation of Liability

To the maximum extent permitted by law, BaytByte, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Reliance on nutritional information provided by the Service

In no event shall our total liability to you for all claims exceed the amount you have paid to us for the Service in the past twelve months.

9. Indemnification

You agree to defend, indemnify, and hold harmless BaytByte, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in Berlin, Germany.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the app settings.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
